Conditions of Use
1 Formation of Agreement
1.1 The clickateeonline.com Online booking facility (”Booking Facility”) is owned and operated by Loftec Private Limited (”Loftec”). When you use the booking facility to make a tee-time reservation, you signify your agreement to these Conditions of Use and other applicable terms, conditions, and notices. If this is not your intention and you disagree with any part of these Conditions of Use or such other applicable terms and conditions, DO NOT USE the booking facility.
1.2 The information contained in the Booking Facility may change without notice. Loftec does not warrant nor represent the accuracy or completeness of the Booking Facility or any of the data or information contained in the Booking Facility.
2 Booking Rules & Cancellation Policy
2.1 You may make reservations up to 14 days in advance for up to 4 players per golf flight.
2.2 Reservations are subject to the applicable green fees and tee-time available on the Booking Facility.
2.3 You are only required to make payment of the green fees at the Golf Club. Your credit card information is only required by the Booking Facility to guarantee your tee-time reservations and charge any applicable cancellation fee. The credit card holder must be part of the golf flight.
2.4 In the event that you decide to cancel your reservation, you will be liable for any cancellation fee specified under the Golf Club’s Rules and Regulations.
3 Disclaimer
3.1 The clickateeonline.com Online booking facility is provided “as is” and you assume total risk and responsibility for your use of the booking facility. To the maximum extent permitted by law, Loftec specifically disclaims and you waive all warranties, express or implied, in respect of the booking facility including merchantability, fitness for a particular purpose, non-infringement of intellectual property or other proprietary rights or compatibility between the clickateeonline.com Online booking facility and any software or hardware, and Year 2000 compliance.
4 No Representation
4.1 Loftec does not warrant or represent that your access to and/or use of the clickateeonline.com Online booking facility will be uninterrupted or error-free or that any information, data, content, software or other material accessible through the clickateeonline.com Online booking facility will be free of bugs, viruses, worms, Trojan horses or other harmful components.
5 Limitation of Liability
5.1 To the maximum extent permitted by law, Loftec is not liable for any injury, loss, claim, damage, including those based in negligence, whether actual, incidental, special, exemplary, punitive or consequential (including lost profits or other special damages) which arises out of or is in any way connected with any of the following items:
a. access or use of the clickateeonline.com Online booking facility;
b. data, information or material contained in the clickateeonline.com Online booking facility including the use of such data, information or material to check prices and availability or for reservations or any other use;
c. submission of any personal or business information, including bank and credit card details;
d. unavailability of the clickateeonline.com Online booking facility to you in whole or in part or any failure or delay in any way connected with the use of the booking facility, including the use of or inability to use the clickateeonline.com Online booking facility to check prices and availability or for reservations or any other use;
e. the performance or non-performance by Loftec or the failure of any function or service associated with the clickateeonline.com Online booking facility, in whole or in part;
f. any unauthorised access or breach of security into the clickateeonline.com Online booking facility; and
g. any reservation made through the clickateeonline.com booking facility that has not registered or is incomplete or is delayed or is in error.
5.2 If Loftec is found liable for any loss or damage which arises out of or is in any way connected with any accessing or use of the clickateeonline.com Online booking facility then the liability of Loftec will in no event exceed, in the aggregate, any subscription fee and/or service charge for accessing the clickateeonline.com Online booking facility.
